Terms of Service

These terms govern your use of DigitalMe. The short version: your vault is yours, our one job is to keep it, you direct your DigitalMe and are responsible for what you ask it to do, and we are not on the hook for actions an AI takes in the real world. Please read the whole thing.

This draft is here so the product flow can be reviewed. Entity, jurisdiction, billing, retention, dispute, and contact details are still being finalized with counsel.

1 What the service is

DigitalMe gives you (a) a private data vault that you own and we keep, and (b) a DigitalMe, an AI aligned to you that you direct. This version of the service is for a vault aligned to a person (you). Other vault types are not offered under these terms and will have their own terms if and when we introduce them.

2 Our one core promise: we keep your vault

Our promise to you is to keep your vault: to store it, protect it as described in our Privacy Policy, and make it available to you. That is what you are paying for. We do not promise that your DigitalMe is the most capable AI, only that it is aligned to you and that your data stays yours.

3 Your ownership, your control, your responsibility

  • You own your vault and everything in it.
  • You direct your DigitalMe. You are responsible for the instructions you give it and for reviewing what it does on your behalf before you rely on it.
  • Your DigitalMe is a tool you control, not our agent. We do not supervise, and are not responsible for, the decisions you or your DigitalMe make.

4 Not professional advice

Your DigitalMe and its outputs are for your own use and convenience. They are not legal, financial, medical, or other professional advice, and they may be wrong or incomplete. Verify anything important before acting on it. The service is provided "as is" and "as available," without warranties of any kind to the fullest extent the law allows.

5 Acceptable use

Only save data you have the right to hold. Do not use the service to break the law, infringe anyone's rights, or harm anyone. Do not use your DigitalMe to take real-world actions (operating vehicles or machinery, moving money, or anything safety-critical) where an error could cause injury or loss. Any such use is at your sole risk and is outside the service we provide.

6 Limitation of liability

To the fullest extent the law allows:

  • We are not liable for any act or decision of your DigitalMe, or of any AI you direct through the service, including any real-world action taken on your instruction or on its own. You assume that risk.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.
  • Nothing here limits any liability that cannot be limited by law.

7 About "forever"

When we talk about keeping your data "forever," we mean our intent and how we have designed the service, not an absolute or perpetual guarantee. We will keep your vault for as long as your account is active and these terms are in force, and we will give you advance notice and a way to export your data before discontinuing the service. We are not liable for data loss caused by events beyond our reasonable control, though we maintain backups as described in our Privacy Policy.

9 Suspension and ending the service

You can stop using the service and delete your vault at any time. We may suspend or end your access if you breach these terms or where we must to comply with the law, with notice where practical, and we will give you a way to export your data except where we are prohibited from doing so.

10 Changes to these terms

We may update these terms. If a change is material, we will post it here and, where the law requires, notify you, with a chance to review before it takes effect.
